The website "https://puppies-yoga.com" (hereinafter referred to as "the Site") is the e-commerce site of the company AEY Development accessible via the internet, open to any user of this network.

It is published by the company AEY Development, operating under the brand "Puppies & Yoga" 


The site allows users to purchase services and/or products offered by Puppies&Yoga.

The site does not allow the purchase of services or products for resale. Consequently, the site user cannot claim against Puppies&Yoga any loss of opportunity, exploitation, or profit.

ARTICLE 1 – SCOPE

These General Terms and Conditions of Sale and Use are concluded between, on the one hand, Puppies&Yoga, and on the other hand, any natural or legal person making a purchase of services and/or products on the Site (hereinafter referred to as the "Client").

They are systematically provided or delivered to each Client to enable them to make purchases of services and/or products offered by Puppies&Yoga.

Therefore, placing an order implies the full and unconditional acceptance by the client of these conditions, regardless of any contrary provisions that may appear on any document issued by the client, including any general terms of purchase.

The client acknowledges having read, at the time of each order, these General Terms and Conditions of Sale and Use and expressly declares to accept them without reserve.

Puppies&Yoga reserves the right to modify its General Terms and Conditions of Sale and Use at any time. In this case, the applicable conditions will be those in force on the date of the order.

The fact that Puppies&Yoga does not avail itself of any of the provisions of these General Terms and Conditions of Sale and Use does not constitute a waiver and does not deprive the company Puppies&Yoga of the possibility of invoking them later.

ARTICLE 2 – SERVICES OFFERED AND PRODUCTS SOLD

Services

The services offered are those presented on the Site, including yoga classes with puppies.

The services offered involve the reservation of one or more spots for a session in a group class. Reservations can only be made directly on the Site.

ARTICLE 3 – PRICES

The prices of the products and services offered on the Site are in euros and include all taxes. Any delivery charges are the responsibility of the Client.

The prices of the products and services are those in effect at the time of the order registration by the client.

ARTICLE 4 – ORDERS

4.1 Common conditions for any order
Orders are placed directly on the Site.

The client wishing to purchase a product or service must:

- Fill out the identification form, providing all the requested details, or provide their customer number if they have one.
- Fill out the online order form by providing all the references of the chosen products or services.
- Validate the order after checking it.
- Make the payment under the specified conditions.
- Confirm the order and payment.

Any order constitutes an express and irrevocable acceptance of the prices and descriptions of the products and services, as well as the present terms and conditions.

Puppies&Yoga confirms the order to the client by email within 24 hours.

For all stages of accessing the Site, the order process, delivery, or subsequent services, Puppies&Yoga has an obligation of means only.

Its responsibility cannot be engaged for any inconvenience or damage inherent to the use of the Internet, including service interruption or connection failure to the Site, external intrusion, or the presence of computer viruses, or any event qualified as force majeure according to jurisprudence and law.

In accordance with the provisions of Article L. 122-1 of the Consumer Code, Puppies&Yoga will be entitled to refuse any abnormal order or made in bad faith, as the Site is intended for consumer sales and does not allow the purchase of products in large quantities for resale.

4.2 Special conditions for a service order

The client expressly and irrevocably acknowledges and accepts the following:

Certificate and Medical Certificate: The client acknowledges having perfect knowledge of the nature of the physical exercises practiced in the courses and sessions they have ordered from the Puppies&Yoga studio and certifies on their honor that their physical condition and health allow them to practice sports in general, and more specifically the activities ordered from Puppies&Yoga.

The client releases Puppies&Yoga, the company Puppies&Yoga, its directors, and its members from all claims and legal actions related to injuries or damages caused to them in any way arising or due to the activity carried out. The client agrees to assume all risks and consequences related to the activity carried out at Puppies&Yoga.

In any case, the client undertakes to inform Puppies&Yoga about their medical history and to provide Puppies&Yoga with a medical certificate dated within three months when required by the instructors. If the medical certificate indicates that the client is not fit to practice the ordered activity, Puppies&Yoga is entitled to terminate the contractual relationship with the client concerned without notice or compensation, and the client will be refunded for all or part of the ordered services depending on the services already performed.

Given the pop-up nature of our events, all ticket sales are final and non-refundable. However, we do offer the possibility to change your class up to 3 days before the event !

Loss and theft: The client acknowledges being informed that, within the studio premises, they must leave their personal belongings in the cloakroom at the studio entrance. Puppies&Yoga is not responsible for the loss or theft of personal belongings, which are solely the responsibility of the client.

Puppies&Yoga cannot be held responsible in any case for the loss or theft of personal belongings deposited by the client within the studio premises, especially in the dressing rooms or lockers.

Insurance: The client acknowledges being informed by Puppies&Yoga of the importance of taking out a personal injury insurance contract covering the bodily injuries to which their sports practice may expose them in accordance with Article L 321-4 of the Sports Code.

Safety instructions: Puppies&Yoga's liability cannot be engaged in the event of an accident resulting from the non-compliance with safety instructions issued by the instructors, or the inappropriate use of equipment or other facilities.

ARTICLE 5 – PAYMENT

The services and products offered on the Site are payable at the time of the order.

5.1 Payment methods

The customer's purchases are paid through Stripe by credit card: "CB" network cards, Visa, Eurocard/Mastercard,

or by PayPal.

5.2 Default of Payment

Puppies&Yoga reserves the right to refuse to honor an order for services and/or products from a customer who has not fully paid a previous order or with whom a payment dispute is ongoing.

Puppies&Yoga reserves the right to suspend or cancel any order and/or delivery, regardless of their nature and level of execution, in case of non-payment of any sum due by the Client, or in case of payment incident.

5.3 Retention of Ownership

It is agreed that the products delivered and invoiced to the Client remain the property of Puppies&Yoga until full payment of their price.

ARTICLE 6 – RIGHT OF WITHDRAWAL AND RETURNS

Given the pop-up nature of our events, all ticket sales are final and non-refundable. However, we do offer the possibility to change your class up to 3 days before the event !

By accepting these conditions, you acknowledge having read, understood, and accepted the terms of this refund clause for Puppy Yoga courses. Please note that Puppies&Yoga reserves the right to modify this clause at any time without notice, and any modifications will apply to future bookings.

ARTICLE 7 – ELECTRONIC FILES OPERATING RULES / INFORMATION TECHNOLOGY AND FREEDOM

7.1 Information Technology and Freedom

The client is informed that, in accordance with Law No. 78-17 of January 6, 1978, relating to information technology, files, and freedoms, the information they communicate through the forms on the Site is necessary to respond to their requests and is intended for Puppies&Yoga, as the data controller, for administrative and commercial management purposes.

Puppies&Yoga undertakes that no personal information of the client will be published without their knowledge, exchanged, transferred, assigned, or sold on any medium to third parties.

In accordance with Article 34 of Law No. 78-17 of January 6, 1978, relating to information technology, files, and freedoms, the client has a right of access and rectification concerning the data concerning them, a right they can exercise by writing to the following address: Puppies&Yoga – 11 rue Edmond Valentin, 75007 Paris.

This automated processing of information has been the subject of a declaration to the CNIL, number pending.

7.2 Cookies

The Site uses cookies. A cookie is a computer file stored on the hard drive of the client's computer. Its purpose is to indicate a previous visit to the Site and therefore does not allow identification or constitute Personal Information. Cookies are used by Puppies&Yoga only to personalize the service offered. The client retains the option to oppose the recording of cookies by configuring their internet browser, which may result in the inability to access certain services.

ARTICLE 8 – INTELLECTUAL PROPERTY RIGHTS

The Site is a protected work and remains the exclusive property of Puppies&Yoga, which created and published the web pages, images and script sources, and the underlying data. Unless otherwise stated, Puppies&Yoga holds the copyright on each of the pages making up the Site, its structure, as well as on each of the elements that compose it: trademarks, logos, illustrations, drawings, models, photographs, images, and more generally all other elements present on the Site, whether registered or not.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Site, regardless of the means or process used, is prohibited without the prior written authorization of Puppies&Yoga.

Any unauthorized use of the Site or any of its components will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L. 335-2 and following of the Intellectual Property Code.

ARTICLE 9 – RIGHT TO IMAGE

By registering and participating in the puppy yoga class (hereinafter referred to as "the class") offered by Puppies&Yoga, you agree to the terms of this customer image use clause. This clause governs the use of images, photographs, videos, or any other visual content (collectively referred to as "visual content") captured during the class.

Consent to image use: By participating in the class, you consent to your image, including your face, being captured and used by Puppies&Yoga for promotional, advertising, and marketing purposes, including on its website, social media, communication materials, and publications.

Use of visual content: By accepting this clause, you grant Puppies&Yoga a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and publicly perform the visual content captured during the class, for the purpose of promoting and marketing the class and related activities of Puppies&Yoga.

Responsible use: Puppies&Yoga commits to using visual content responsibly and respecting your privacy. However, you acknowledge that Puppies&Yoga cannot guarantee absolute confidentiality of the images or videos captured during the class, especially in the event of hacking or inadvertent disclosure.

Right of withdrawal: If you wish to request the removal of a specific image in which you appear, you can contact Puppies&Yoga by providing specific details about the relevant image. Puppies&Yoga will strive to process your request promptly, subject to its legal obligations.

Responsibility of Puppies&Yoga: Puppies&Yoga undertakes to use visual content in a professional and respectful manner. However, Puppies&Yoga cannot be held responsible for the misuse or unauthorized use of visual content by third parties once it has been made public in accordance with this clause.

ARTICLE 10 – FORCE MAJEURE

The performance by Puppies&Yoga of all or part of its obligations will be suspended in the event of an unforeseeable event or force majeure that hinders or delays its performance. This includes, among other things, war, riots, insurrection, social unrest, all kinds of strikes, and supply problems at Puppies&Yoga. Puppies&Yoga will inform the client of any unforeseeable event or force majeure within seven (7) days of its occurrence.

ARTICLE 12 – DISPUTES, APPLICABLE LAW, AND JURISDICTION

These Conditions are subject to French law and governed by the French language for their interpretation.

Any dispute arising from the validity, interpretation, execution, termination, consequences, and follow-ups of these General Terms and Conditions of Sale and Use will be submitted to the exclusive jurisdiction of the French courts.

ARTICLE 13 – INDEPENDENCE OF CLAUSES

If any provision of these General Terms and Conditions of Sale and Use is deemed null or unenforceable, the validity or enforceability of the other provisions of the General Terms and Conditions of Sale and Use will not be
